El órgano colegial lucentino ha interpuesto recurso administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Supremo contra el Real Decreto 422/2025.
El Iltre. Colegio de Abogados de Lucena, a través de su Junta de Gobierno, acordó en la sesión de 17 de junio pasado interponer recurso administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Supremo contra el Real Decreto 422/2025.
Dicho Decreto extiende la jurisdicción del Tribunal de Instancia de Córdoba al partido judicial de Lucena en materia de violencia sobre la mujer a partir del 1 de enero de 2026. Esto supone que los asuntos de violencia de género que se produzcan en el partido judicial de Lucena (Benamejí, Encinas Reales, Iznájar, Palenciana, Rute y Lucena) ya no serán tramitados directamente por el Tribunal de Instancia lucentino, sino que serán competencia de la Sección de Violencia sobre la Mujer del Tribunal de Córdoba.
A efectos prácticos, las mujeres víctimas de violencia (de género y sexual) se verán obligadas a desplazarse a Córdoba para la tramitación de sus denuncias, lo que supone una clara contradicción con el espíritu de la Ley Orgánica de Medidas de Protección Integral contra la Violencia de Género y del propio Real Decreto, que promueve una “proximidad razonable del órgano judicial respecto a la víctima”. Se trata, en definitiva, de un obstáculo añadido a la dificultad que de por sí encuentran las mujeres víctimas de violencia para iniciar sus denuncias, considerándose que lo que debería promoverse es la incentivación a denunciar y la facilitación del acceso a la justicia y no lo contrario, que es lo que impone el Real Decreto.
Sensible con lo que se considera una conculcación de los derechos constitucionales de las mujeres víctimas de violencia de género, el Iltre. Colegio de Abogados de Lucena ha decidido llevar al Alto Tribunal esta cuestión, interponiendo recurso contencioso-administrativo contra el Real Decreto, lo que llevó a efecto en el día de ayer.
